A. The Landlord has the obligation to provide written notice of any information in the Designated Substances Report (Examination of Building Materials, such as ASBESTOS is required when friable materials are present in the [living] space / building, and the Landlord has repeatedly claimed the building to be asbestos free) to the Tenant (s) under the OHSA (O. Reg. 278/05: DESIGNATED SUBSTANCE - ASBESTOS ON CONSTRUCTION; PROJECTS AND IN BUILDINGS AND REPAIR OPERATIONS under Occupational Health and Safety Act, R. S. O. 1990, c. O. 1)
B. City of Kingston By-Law Number 2015-15: [11.2] Where a provision of this By-Law conflicts with the provision of another By-Law in force in the City, the provisions that establish the higher Standards to protect the health, safety and welfare of the general public prevails
C. The Section 20 of the Residential Tenancies Act states:
1. A landlord is responsible for providing and maintaining a residential complex, including the rental units in it, in a good state of repair and fit for habitation and for complying with health, safety, housing and maintenance standards.
2. Subsection (1) applies even if the tenant was aware of a state of non-repair or a contravention of a standard before entering into the tenancy agreement.

Note:
The act of the Property Owner providing the Tenant with a space intentionally filled with a pile of wall debris, friable materials, and dusts, and saying "the space is ready for your use” could be interpreted as an intentional tort.

My partner and I recently tried to sign a lease with this company and I wish I could say we had a positive experience. Frontenac strung us along for over 5 weeks after we had provided all the necessary documentation for an application. During this time, communication was not well-reciprocated and we had to continuously reach out again and again for updates on our application. I am empathetic for the challenges their staff may have to face in light of the pandemic and staff shortages etc.but we both felt that the situation was not handled well due to lack of responsiveness and care. It truly felt as though they were waiting and waiting until a “better” applicant came along so that they could finally tell us we were not approved. Luckily we found a place elsewhere and had a much easier and straightforward application process. Just something to be mindful of!

As a tenant, and I'm willing to bet one of their longest standing tenants as we have been renting from them before the office was at its King St locale, I can say, whole heartedly this company is amazing. Every issue we have ever had between the 2 properties we have been tenants of has been handled in a timely manner, and with the utmost professionalism. Every company that they are affliated with, Knapps Appliances, First Capital Construction, just to name a few are wonderful as well.
I can't remember names because in the past 9 years, people have come and gone but those people have always been absolutely fantastic. Keep doing what you're doing and don't let the haters stop you from doing what you're doing. We have recommended this company to many people over the years and will continue to do so. My son and I have tried numerous times to see a particular house and each time have received the same response. Too many people or house has been rented. House rented was a lie. Website Said that it was rented. Guess what, house up for rent again and told again that it is rented.
