All of the reviews I had the patience to read, were left by idiots. I feel bad for the people who answered their calls. When you are unionized, these guys can't help. That isn't their fault. It's kinda your fault for not knowing your rights, certainly your fault for getting upset that they can't undue the law and help. The girl who assisted me was very friendly and helpful. She explained who I needed to call, both who it might be, given my circumstances. My call was answered quick and I felt this service was very helpful to me today. Thank you.

Mediator Laurie Eisenberg told me during the first hearing that "you never win againts union" and she was right.

I had worked for the Delta hotel for approximately 15 years and the Marriott hotel for approximately 10 years when, in March of 2020, I was temporarily laid off by each hotel due to issues related to the COVID-19 pandemic. In the two years that followed, the UniteHere did little to explain to me what was happening with my employment.the Union entered into agreements with the Employers that affected my rights without having communicated with me what those agreements might mean; I only became aware of said agreements once they had already been signed. I have little doubt that the Union would have received significant pressure from the Employers to enter into said agreements so that they (the Employers) could avoid having to pay into trust the termination and severance pay to which employees would have otherwise been entitled pursuant to the ESA.
Further, the Union failed to properly put the election contemplated by section 67 (3) of the ESA and/or section 4 of Ontario Regulation 764/20. It is my position that the Union was required to advise me of my right to make an election and of the consequences of the choice I might want to make I had no recollection of the Union advising me of my right to make an election and, as stated above, no recollection of the Union advising me that they were considering entering into agreements with the Employers that might affect my rights. I have asked the Union for proof as to how they notified me of having to make an election and for information regarding the steps the Union took to keep employees informed of what was happening with their employment and what their options might be in the circumstances. They have yet to provide this. In addition, when I did purport to resign from the Employers by email, I copied the Union on those communications. Rather than responding immediately to me to explain the impact of the agreements that had been entered into, and to support my position vis-à-vis the Employers, the Union did nothing. I also had serious concerns about the recall process that was followed. In particular, i believed I should have been recalled to the Delta sooner as I was aware of others having been recalled. I was only recalled once I made my request for termination and severance pay; in fact, I was recalled the following day. There were also unexplained changes made to my job title while I was on layoff, which changes were undone upon my purported resignation. Again, this raises the question of whether the proper recall process was followed and, further, whether the Union did everything it could to ensure the Employers were abiding by the terms of the collective agreements and ESA pertaining to recall.

Unfair decision by OLRB has declined to alter its earlier decision.

I want to go to Divisional Court to ask them to overturn the Board's decision in what is called an "application for judicial review".

I have just completely lost faith in due process because we have just been told a couple of guys in a small company must remain in a shifty, dirty, sleazy union the 787 local. Which means now we will have no jobs to feed our families because the company cannot afford a union. As well they keep our money for 6 months and collect interest on it while we starve. Their union reps will contact past disgruntled employees and ask them to testify against the company in order to solve a personal vendetta and yes I have those emails Ian. I will never pay into a union nor do I believe in them they do not protect they ensnare.

There were spelling errors in the decision written by the VC for my case. Thanks for rushing through something I worked extremely hard on. Did not even read the merits of my argument.
